These terms apply to every order placed on jcbphone.com. They set out the contract between you and us, and your key legal rights as a UK consumer. Please read them before you order — by placing an order you agree to the version of these terms in force at that time.

Who we are

jcbphone.com is operated by Genuine Case Company Limited, trading as JCB Phone, a company registered in England and Wales under company number 12199129. Our registered office is at Southlands, Wybunbury Lane, Stapeley, Nantwich, Cheshire, CW5 7HH. You can contact us at support@jcbphone.com.

We are a UK business and these terms are governed by the law of England and Wales. If you live elsewhere in the UK, this does not remove any protection given to you by the law of the country you live in, and you can still bring proceedings in your local courts.

How a contract is formed

Placing an order is an offer by you to buy. We'll email you to confirm we've received it — that confirmation isn't acceptance, just an acknowledgement. The contract between us is formed when we dispatch your order and send you a dispatch confirmation. We reserve the right to decline any order before that point, including where we suspect fraud, where an item is unexpectedly out of stock, or where a pricing or listing error has occurred.

Products, pricing and availability

We try to describe and picture our products as accurately as possible, but colours and finishes can vary slightly on screen. Product descriptions and prices may change, and we may withdraw or discontinue a product, at any time before your order is dispatched — this won't affect an order we've already dispatched to you.

All prices shown include VAT. Delivery costs are shown separately at checkout and depend on your order — see our Delivery Policy for current rates, cut-off times and free-delivery thresholds. We currently deliver within the UK only.

Payment

Payment is taken through Shopify Payments and the other payment methods offered at checkout. We use a secure payment gateway and don't store your full card details — see our Privacy Policy for how we handle payment and order information.

Cancelling your order shortly after ordering

If you change your mind within 30 minutes of ordering, email us at support@jcbphone.com and we'll usually be able to cancel before dispatch at no cost to you. After that, or if we've already dispatched your order, you can still exercise your legal right to cancel below.

Your legal right to cancel (14-day cooling-off period)

As a UK consumer buying at a distance, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel your order for any reason, without needing to give a reason, within 14 days of receiving your goods.

To cancel, tell us clearly — an email to support@jcbphone.com is enough. You then have a further 14 days to send the goods back to us. Unless the goods are faulty or not as described, you'll need to cover the cost of returning them, and we may reduce your refund if the goods show more handling than necessary to check they work as expected. We'll refund you within 14 days of getting the goods back (or of you providing evidence you've sent them), using your original payment method.

This is a legal minimum. We currently offer a more generous 30-day change-of-mind window as standard — see our Returns Policy for the full, practical details of how to return an order.

Faulty or misdescribed goods, and your statutory rights

Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015. Goods we sell must be of satisfactory quality, fit for purpose, and as described. If they aren't:

  • Within the first 30 days, you can get a full refund or a replacement.
  • Within the first 6 months, if a repair or replacement isn't possible or doesn't fix the problem, you're entitled to a refund or price reduction, and it's for us to show the fault wasn't there from the start, not you.
  • Up to 6 years from purchase (England and Wales; different time limits apply in Scotland), you may still have a claim, though the burden shifts to you to show the goods were faulty when supplied.

Separately, we back JCB Toughphone and Tough Tablet products with a 24-month manufacturer warranty, and cases and accessories with a 12-month warranty against manufacturing defects — see our Warranty page for what's covered and how to claim. These warranties sit alongside your statutory rights above; they don't replace or limit them.

To report a fault or make a claim under either your statutory rights or our warranty, contact support@jcbphone.com with your order number.

Connected devices

Our JCB Toughphone and Tough Tablet products are internet-connectable and comply with the UK's Product Security and Telecommunications Infrastructure (Security) Regulations 2023. See our Compliance and PSTI page for supported software update periods and how to report a security issue.

Fraud prevention and order refusal

We may refuse, limit or cancel an order, including after you've received an order confirmation, if we reasonably suspect fraud or if an order appears to be for resale rather than personal use. Where we do this we'll try to let you know using the email address or phone number you gave us. If we've already taken payment for an order we cancel on this basis, we'll refund you in full.

Our liability to you

We don't exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law doesn't allow us to exclude or limit — including your statutory rights under the Consumer Rights Act 2015 described above.

Subject to that, our liability to you for losses you suffer as a result of us breaking this contract is limited to losses that are a foreseeable result of us doing so at the time the contract was formed. We aren't liable for losses that aren't foreseeable, for losses that aren't caused by our breach, or for business losses if you're using the products for business purposes rather than as a consumer.

Intellectual property

This website, and the text, images and other content on it, belong to Genuine Case Company Limited or our licensors. You can browse and print pages for your own personal, non-commercial use, but you can't otherwise copy, reproduce or republish any part of the site without our written permission.

Complaints

If something's gone wrong, tell us first at support@jcbphone.com and we'll do our best to put it right. If we can't resolve things between us, you can contact Citizens Advice Consumer Service (adviceguide.org.uk) for guidance, or your local Trading Standards service. We are not currently signed up to an alternative dispute resolution (ADR) scheme, and are not obliged to be, but we'll always try to resolve a complaint directly first.

Other important terms

If any part of these terms is found unenforceable, the rest continues to apply. If we don't immediately insist you do anything you're required to do under these terms, that doesn't mean we've waived our rights and we can still require you to do it later. The headings in these terms are for convenience only.

We may update these terms from time to time, for example to reflect changes in law or in how we operate. The version that applies to your order is the one in force on the date you order. We'll always tell you directly if a change materially affects an order you've already placed.
